Terms of Service

These Terms govern access to and use of FastFlare (https://fast-flare.com), including the dashboard, API, starter templates, automation, shipping-operation workflows, integrations, analytics, and related services.

1. Accounts and use

You are responsible for your account, connected stores, shipping data, carrier accounts, automation rules, API keys, uploaded files, and team access. Keep credentials secure and use the service only for lawful business operations.

You are responsible for managing team permissions, connected accounts, devices, backups, deployments, production configuration, and internal processes used with the service or any software built from it.

2. Integrations and data

You control which stores, carriers, and tools you connect. You must have the right to send data into FastFlare and to use each connected provider. If you use FastFlare as a software foundation or template, you are responsible for your own product, customers, legal notices, security review, deployments, and commercial use.

If you copy, fork, customize, deploy, resell, or operate software based on FastFlare, you are responsible for reviewing the code, configuration, dependencies, legal pages, privacy notices, authentication rules, permissions, data flows, security controls, compliance needs, and production readiness for your own use case.

3. Subscriptions, cancellations, and refunds

Subscription terms, plan access, billing dates, and fees are shown in the product, checkout, invoice, or written agreement. You can stop using the service or cancel according to the applicable plan terms. Except where required by law or expressly agreed in writing, fees already paid are non-refundable, including unused time on a billing period. If a payment is late, fails, is disputed, or is reversed, we may pause access, withhold features, or suspend service until the account is regularized. Duplicate charges or clear billing errors should be reported to legal@fast-flare.com.

4. Connected systems and consent

If you connect stores, carriers, customer data, scripts, API keys, or automations, you are responsible for giving the notices and obtaining the permissions or consents required for your customers, shipments, and jurisdictions.

You are also responsible for customer communications, checkout or payment notices, shipment data handling, privacy notices, cookie or tracking notices, export or import obligations, and any regulatory requirements that apply to your business.

5. Fair use and acceptable use

We may apply reasonable fair-use limits, rate limits, storage limits, or abuse-prevention controls to protect the service and other users. Do not use FastFlare for unlawful shipments, fraud, spam, phishing, malware, sanctions evasion, or activity that harms the platform, partners, carriers, or third parties. FastFlare is software and is not a carrier, freight forwarder, customs broker, or insurer unless expressly agreed in writing.

6. Template and production responsibility

Unless expressly agreed in writing, starter templates, code examples, automation flows, integrations, and implementation guidance are provided as a technical foundation, not as a guarantee that your final product is secure, compliant, complete, or suitable for every business or jurisdiction.

You are responsible for testing, auditing, adapting, monitoring, maintaining, and operating any deployment, fork, derivative product, customer-facing service, or internal system built with or inspired by FastFlare.

We do not guarantee compliance with specific frameworks or requirements such as GDPR, PCI DSS, HIPAA, SOC 2, ISO 27001, customs rules, carrier rules, tax rules, or industry-specific obligations unless expressly agreed in writing.

7. Third-party services and integrations

The service may depend on third-party providers such as Cloudflare, Stripe, carriers, ecommerce platforms, email providers, analytics tools, APIs, package dependencies, open-source libraries, and other integrations. You are responsible for approving, configuring, maintaining, updating, and complying with the terms of third-party services you connect, deploy, or use with FastFlare.

We are not responsible for third-party outages, pricing changes, account suspensions, rejected payments, API changes, package vulnerabilities, dependency changes, data loss, security incidents, or service limitations outside our direct control.

8. Data, security, and cyber incidents

We use reasonable professional care and appropriate technical and organizational measures for the service, taking into account the nature of the platform, the tools used, the state of the art, implementation costs, and the risks involved.

No digital system, starter template, dependency, deployment, or integration can be guaranteed to be fully secure, uninterrupted, error-free, or immune from vulnerabilities, cyberattacks, data breaches, unauthorized access, malware, service outages, third-party failures, or data loss.

You remain responsible for your business, customers, shipments, accounts, users, access permissions, internal devices, backups, deployments, data governance, legal compliance, third-party providers, payment processors, carriers, stores, APIs, environment variables, secrets, and any systems or credentials outside our direct control.

To the fullest extent permitted by law, we are not responsible for security incidents, data loss, downtime, unauthorized access, fraud, or cyber events caused by third-party services, compromised or shared credentials, client instructions, client-side configuration, forks, code modifications, dependency changes, deployment choices, legacy systems, unpaid or disabled external services, other vendors, user behavior, or vulnerabilities that were not reasonably detectable at the time.

If we become aware of a relevant security incident affecting the service or personal data processed on your behalf, we will notify you without undue delay and cooperate reasonably so the issue can be reviewed, contained, or remediated.

Where we process personal data on your behalf, your organization remains the controller unless agreed otherwise, and we act only on your documented instructions. If a data processing agreement is required, the parties will put one in place separately.

9. Availability and changes

We work to keep the service reliable, but we do not guarantee uninterrupted availability, response times, data sync timing, carrier uptime, payment provider uptime, dependency availability, or delivery of emails, messages, notifications, or webhooks. Features may change as the product evolves.

10. Liability

To the fullest extent permitted by law, FastFlare is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, shipments, customers, deliveries, carrier fees, chargebacks, refunds, deployment failures, security events, reputation, or goodwill.

To the fullest extent permitted by law, our total liability for any claim relating to the service, template, or software foundation is limited to the amounts paid to us by your organization for the service during the three months before the event giving rise to the claim.

11. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules.
